2. Subject of the contract

The subject of the contract is the sale of goods.

 

3. Conclusion of the contract

The contract is concluded exclusively in electronic business transactions via the store system.

The contract is concluded via the online shopping cart system as follows:

The goods intended for purchase are placed in the "shopping cart/cart". You can call up the "Shopping Cart/Cart" via the corresponding button in the navigation bar and make changes there at any time.

If you use an instant payment system (e.g. PayPal / Klarna Sofortüberweisung or iDeal) as a payment method, you will either be taken to the order overview page in our online store or you will first be redirected to the website of the instant payment system provider.

If you are redirected to the respective instant payment system, make the appropriate selection or enter your data there. Finally, you will be redirected back to our online store to the order overview page.

Before sending the order, you have the opportunity to check all the information again, change it (also using the "back" function of the Internet browser) or cancel the purchase.

By sending the order via the "buy" button, you declare the legally binding acceptance of the offer, whereby the contract is concluded.

4. Shipping / Prices

Unless otherwise stated in the product description of the seller, the prices quoted are total prices that include the statutory sales tax. Any additional delivery and shipping costs will be indicated separately in the respective product description.

The delivery conditions, the delivery date and any existing delivery restrictions can be found under a correspondingly designated button on our website or in the respective offer. 

 

5. Order

The processing of the order and transmission of all information required in connection with the conclusion of the contract is carried out by e-mail, in part automatically. You must therefore ensure that the e-mail address you have provided to us is correct, that the receipt of e-mails is technically ensured and, in particular, that it is not prevented by SPAM filters.

 

6. right of retention, reservation of title

6.1 You may only exercise a right of retention insofar as it concerns claims from the same contractual relationship.

6.2 The goods remain our property until full payment of the purchase price. 

 

7. Warranty

7.1 The statutory rights of liability for defects shall apply.

7.2 As a consumer, you are requested to check the goods immediately upon delivery for completeness, obvious defects and transport damage and to notify us and the carrier of any complaints as soon as possible. If you do not comply with this, this has no effect on your statutory warranty claims.

 

8. Choice of law

8.1 German law shall apply. In the case of consumers, this choice of law shall only apply to the extent that the protection granted by mandatory provisions of the law of the country of the consumer's habitual residence is not thereby withdrawn (favorability principle).

8.2 The provisions of the UN Convention on Contracts for the International Sale of Goods shall expressly not apply.

 

9. Delivery

9.1 Delivery is within 3-5 business days for shipping in Germany. Within the EU, delivery times vary depending on the country. The customer will be informed about delays immediately by email. If Treehuggr has a permanent obstacle to delivery and is not able to deliver the goods in the specified delivery period, especially due to force majeure or non-delivery by its own suppliers, although a corresponding covering transaction was made in time, both the customer and Treehuggr have the right to withdraw from the contract with the respective other party.

The customer will be informed of this immediately and any services received, in particular payments, will be refunded by Treehuggr.

9.2 Vouchers 'Gift Cards' will be sent by treehuggr to the customer by email immediately after receipt of payment.

9.3 Sold-out products can be pre-ordered under the 'Pre-Order' option. After the next production round has been carried out, the customer will be informed immediately about the exact delivery date.

 

10. Revocation and right of return

10.1 There is a 14-day right of withdrawal. Items such as vouchers are excluded from return. The return of yoga mats is possible within 14 days. If the customer is not satisfied with a product, contact Treehuggr by email via support@treehuggr.com.

12. Exclusion of liability

Claims for damages by the customer are excluded, unless otherwise stated in the following. This also applies to the representative and vicarious agents of Treehuggr, if the customer makes claims for damages against them. Excluded are claims for damages by the customer due to injury to life, body, health or essential contractual obligations, which must necessarily be fulfilled in order to achieve the objective of the contract. Likewise, this does not apply to claims for damages after grossly negligent or intentional breach of duty by the provider or his legal representative or agent.

 

 13. Prohibition of assignment and pledge

Claims or rights of the customer against Treehuggr may not be assigned or pledged without Treehuggr's consent, unless the customer has proven a legitimate interest in the assignment or pledge.

 

14. Severability clause

The invalidity of any provision of these GTC shall not affect the validity of the other provisions.
